Terms of use

These terms govern access to aispotmarket.com, the Spot API, and the marketplace operated by Spot Markets, Inc. ("Spot", "we"). By creating an account, calling the API, or listing capacity you agree to them.
1. What Spot is
Spot matches buyers of inference with sellers of capacity. A fill is a commercial contract for the delivery of compute: tokens at a stated instrument, region, and price. Physical delivery of compute is not a security. Financially-settled products, when offered, are provided through a separate registered entity and are subject to additional terms.
2. Accounts
You must be able to form a contract. Self-serve accounts are issued to individuals or entities you are authorized to bind. Institutional credit, net-30 invoicing, and letters of credit are offered only after review. You are responsible for every request signed with your keys. If a key leaks, revoke it.
3. The book
Orders rest and match on price-time priority. A buyer bid that cannot clear at or under max_price fails; you are not filled above your limit. A seller ask rests at the limit you post. Spot does not trade against the book on its own account. Indicative prices on this website are not an offer to trade.
4. Settlement
Buyer accounts are pre-funded unless the desk has granted credit. A bid that would overdraw is rejected before dispatch. Seller proceeds credit the seller account at the fill price. Cash payouts run same-day at 17:00 ET to the bank account on file. Settlement is idempotent on trade_id. Fees are the published schedule and are charged on notional cleared.
5. Acceptable use
You may not use Spot to attack the matching engine, scrape the tape beyond the published rate limits, resell a data feed you are not licensed to redistribute, or send payloads that venues are not permitted to process. Venues must honor Zero Data Retention (ZDR), no-training, and region-pinning terms. We can suspend an account that breaks these rules or that we reasonably believe is being used for fraud.
6. Quality and uptime
Venues are benchmarked continuously. Drift beyond tolerance delists them from the book. If a venue fails mid-request the router retries inside your price limit and you are billed once. The published SLA and any service credits are in your account terms or an order form, not in this page.
7. Data
Spot operates under Zero Data Retention (ZDR): prompts and completions transit encrypted and are not written to disk. Venues are contractually bound to the same. Market data (fills, the index, depth) is a price feed and does not include prompts. See the privacy policy and the data feeds page for what is public and what is licensed.
8. Disclaimers
The site, the API, and the index are provided as-is. We do not warrant uninterrupted matching, a particular fill price, or that a listed instrument will remain listed. Past prints are not a promise of future prices. To the extent the law allows, Spot's liability for a claim arising from the marketplace is limited to the fees you paid us in the three months before the claim.
9. Changes and law
We can update these terms by posting a new effective date on this page. Material changes to fees or matching rules will also be noted on the changelog. These terms are governed by the laws of the State of California. Courts in the City and County of San Francisco have exclusive jurisdiction, except that we may seek injunctive relief anywhere a key or a data feed is being abused.
